John Lane's article for the TMA's national publication makes the case that receiverships can be a strong alternative to bankruptcy.
In August 2008, an article by John Lane was published in Corporate Renewal, the national publication of the Turnaround Management Association (TMA). Titled "Receiverships May Be Good Alternative to Bankruptcy: A Non-Legal Perspective on the Benefits, Risks," the piece looks at how non-liquidating receiverships can preserve both value and jobs.
Lane's central point is a practical one. Under the right circumstances, a receivership can be more effective and less costly than a bankruptcy filing, giving stakeholders a path to protect an operating business rather than wind it down.
